Terms and Conditions – Balamigo

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “you”) and Balamigo (“we”, “us”, “our”) governing your access to and use of the Balamigo platform, including all event-based chat services. By accessing or using Balamigo, you agree to be bound by these Terms. If you do not agree, you must not use the platform.

1. Description of Service

Balamigo is a real-time event-based chat platform that enables users to create and participate in conversations linked to specific events (including live and scheduled events).

  • Chat rooms are time-bound and may automatically close when the associated event ends
  • Features and functionalities may evolve over time

2. Eligibility

You must be at least 18 years old (or the minimum legal age in your jurisdiction) to use Balamigo. By using the platform, you represent that:

  • You have the legal capacity to enter into this agreement
  • All information you provide is accurate and up to date

3. User Accounts

To access certain features, you may be required to create an account. You agree to:

  • Provide accurate registration information
  • Maintain the confidentiality of your login credentials
  • Accept responsibility for all activities under your account

Balamigo reserves the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use Policy

You agree not to use Balamigo to:

  • Post or share unlawful, harmful, abusive, or offensive content
  • Harass, threaten, or impersonate others
  • Distribute spam, scams, or unauthorized promotions
  • Share misleading or false information related to events
  • Attempt to gain unauthorized access to systems or data

We reserve the right to remove content or restrict access at our discretion.

5. User-Generated Content

Balamigo allows users to create and share content within chats.

  • You retain ownership of your content
  • By posting, you grant Balamigo a non-exclusive, worldwide, royalty-free license to use, display, and process such content for the purpose of operating the service
  • Balamigo does not endorse or guarantee the accuracy of user content

6. Temporary and Event-Based Chats

A core feature of Balamigo is the temporary nature of conversations :

  • Chat rooms may be automatically closed once an event ends
  • Content may be deleted, archived, or made inaccessible
  • Balamigo does not guarantee permanent storage or retrieval of chat data

7. Privacy and Data Use

Your use of Balamigo is also governed by our Privacy Policy. We may collect and process data to:

  • Provide real-time communication services
  • Improve platform performance
  • Detect and prevent abuse

We do not sell personal data to third parties.

8. Third-Party Services

Balamigo may integrate with or link to third-party services. We are not responsible for:

  • Content, policies, or practices of third-party platforms
  • Any loss or damage resulting from their use

9. Service Availability

We strive to provide reliable service but do not guarantee that:

  • The platform will always be available, secure, or error-free
  • Any defects will be corrected immediately

We may modify, suspend, or discontinue any part of the service at any time.

10. Intellectual Property

All rights, title, and interest in the Balamigo platform—including its design, features, and branding—are owned by Balamigo. You may not:

  • Copy, reproduce, or distribute any part of the platform
  • Reverse-engineer or exploit the service

11. Limitation of Liability

To the fullest extent permitted by law, Balamigo shall not be liable for:

  • User interactions or disputes arising within chats
  • Loss of data, including chat content
  • Indirect, incidental, or consequential damages

12. Indemnification

You agree to indemnify and hold harmless Balamigo from any claims, damages, or liabilities arising from:

  • Your use of the platform
  • Your violation of these Terms
  • Your infringement of any rights of a third party

13. Termination

We reserve the right to:

  • Suspend or terminate your access at any time
  • Remove content that violates these Terms

You may stop using the service at any time.

14. Changes to Terms

We may update these Terms periodically.

  • Updated Terms will be posted on this page
  • Continued use of the platform constitutes acceptance of the revised Terms

15. Governing Law

These Terms shall be governed and interpreted in accordance with the laws of the United Republic of Tanzania .
